1.Introduction

  • Welcome to Trueodysseys! The platform is operated by Trueodysseys, UNIPESSOAL LDA, a limited liability company registered in Portugal with NIPC 517661047, and an office at Rua da Prata 80, Lisbon, 1100-415 Lisbon. The mission of Trueodysseys is to facilitate the discovery and booking of experiences and activities, connecting users and partners in a simple and intuitive way.
  • These Terms and Conditions govern the use of the platform, establishing rights and obligations between Trueodysseys, users, and partners.
  • By using the platform, the user accepts these Terms and Conditions. If you do not agree, please do not use Trueodysseys services.

2.Definitions

  • Platform: Refers to the Trueodysseys website and/or mobile application.
  • User: Any person who accesses the platform.
  • Partner: Provider of experiences and activities offered on Trueodysseys.
  • Voucher: A digital title that grants the holder the right to enjoy a specific experience according to the established conditions.
  • Instant Booking: An experience that can be scheduled online and confirmed at the time of purchase, without the need for a later voucher exchange.

3.Platform Usage

3.1.User Account

  • To access certain features, the user may need to create an account, providing accurate and updated information.
  • The user is responsible for maintaining the confidentiality of their login details and for all actions performed on their account.

3.2.Prohibited Use

It is prohibited to use the platform for any illegal or harmful purpose or that violates these Terms and Conditions.

4.Payment Conditions and Methods

4.1.Available Payment Methods

  • Credit/Debit Card (Visa, MasterCard, or equivalents).
  • PayPal (when available).
  • MBWay or Multibanco Reference (when applicable to the Portuguese market).
  • Trueodysseys may, at its discretion, make other payment methods available or discontinue them.

4.2.Purchase Process

  • Experience Selection: The user selects the experience(s) on Trueodysseys, analyzing details, price, and specific conditions (including validity, availability, and cancellation rules, when applicable).
  • Cart: After selection, the user confirms the cart contents (items can be added or removed before payment).
  • Identification: The user may be required to log in or create an account to proceed.
  • Billing Data and Payment: The user confirms and/or enters their billing details (when applicable).
  • Chooses the available payment method and completes the purchase.

4.3.Order Confirmation and Validation Email

  • Once payment is completed, the user will receive a confirmation email.
  • It is the user's responsibility to verify that the received data (e.g., reservation details, attached vouchers) is correct. If an error is detected, the user must contact Trueodysseys immediately.

4.4.Rejected or Failed Payment

  • If payment is declined, the order will not be confirmed, and the user must repeat the process or use another payment method.
  • Fraud Prevention

4.5.Physical Products

Not applicable: Trueodysseys does not sell physical products. All voucher or ticket deliveries for experiences are made digitally (email or personal account).

4.6.Refunds and Returns

  • Trueodysseys complies with Portuguese legislation regarding the right of withdrawal (14 days) when applicable to online purchases that do not involve immediate reservations or experiences that have already been used.
  • For reservations or vouchers already used (or for experiences that have been scheduled and confirmed), the right to a refund does not apply.
  • In case of doubt about refunds, the user should check the Refund Policy section or contact Trueodysseys support.

4.7.Fraud Prevention

  • Trueodysseys may request additional documents to verify the legitimacy of a purchase if there are signs of fraud.
  • In cases of proven fraud or misuse, Trueodysseys reserves the right to block the user's account and/or deactivate associated vouchers.

5.Reservations and Vouchers

5.1.Purchase and Validity

  • Each voucher, ticket, or reservation will have a usage period defined by the partner, visible on the experience page and/or in the confirmation email.
  • The user is responsible for checking the validity conditions and usage of each experience before purchase.

5.2.Exchanges and Cancellations

  • The conditions for exchanges and cancellations vary depending on the experience.
  • For immediate/online reservations: the user can cancel or modify the booking free of charge up to 24 hours before the scheduled experience time (unless otherwise stated on the experience page). If the cancellation occurs less than 24 hours before the start, there may be no refund.
  • For vouchers that require later booking: failure to attend the activity (no-show), without prior notice or rescheduling validated with the partner, will result in cancellation with no right to refund or rescheduling.

5.3.Experience Booking

  • When an experience requires prior booking, the reservation must be made directly with the partner or according to the provided instructions.
  • In case of booking difficulties, Trueodysseys commits to mediating but does not guarantee availability on the desired date.
  • If the partner requires a printed or digital voucher, the user must follow the instructions to ensure access to the experience.

5.4.Instant Reservations

  • Experiences with instant reservations are confirmed at the time of purchase (no separate voucher is required).
  • Cancellations and modifications are possible free of charge up to 24 hours before the experience starts.
  • In case of no-show or late cancellations (less than 24 hours before), there is no right to a refund unless previously agreed upon with the partner.

6.Responsibilities

6.1.Trueodysseys Responsibility

  • Trueodysseys acts solely as an intermediary between users and partners, providing a technological platform for searching, discovering, and booking experiences. It is not a producer, supplier, or organizer of the offered activities.
  • Trueodysseys is not responsible for temporary failures or interruptions on the platform due to maintenance, technical issues, force majeure, or other causes beyond its reasonable control.
  • Trueodysseys also does not take responsibility for damages caused by improper use of the platform, or for any indirect consequences resulting from its unavailability.
  • Trueodysseys makes efforts to verify the reliability and accuracy of the information provided by partners (e.g., experience descriptions, location, availability), but does not guarantee the precision or completeness of this information. The partner is solely responsible for ensuring that their data is correct and up to date.

6.2.Partners' Responsibility

  • Partners are fully responsible for executing the offered activities, including safety, quality, and legality of the provided services.
  • They must ensure they have the necessary licenses, mandatory insurance, and all required documentation for their activities.
  • Each partner must indicate any restrictions (e.g., age, weight, health conditions) and provide appropriate safety equipment when the experience requires it.
  • Partners may make modifications or cancellations in extraordinary cases (e.g., adverse weather conditions). In such cases, they must inform users as early as possible and, if necessary, provide alternatives.

6.3.Users' Responsibility

  • The user must provide accurate personal and contact information, and Trueodysseys or the partner cannot be held responsible for consequences resulting from incorrect data.
  • It is the user's responsibility to verify if they meet the participation conditions set by the partner (e.g., health prerequisites, necessary equipment, prior experience).
  • The user is responsible for following the safety instructions provided and acting diligently during the activities.
  • In case of damages caused by the user to goods, facilities, or third parties, the user assumes full responsibility for costs or compensations that may arise.

6.4.Conditions of Safety and Security

  • Some experiences may involve specific risks (e.g., extreme sports, motorized activities, water activities). The user must evaluate their own physical and mental suitability to participate.
  • If there are adverse weather conditions or other safety-compromising factors, the partner may suspend or cancel the activity. Users should contact Trueodysseys or the partner for more information regarding rescheduling, as outlined in the Terms and Conditions.
  • Safety equipment (e.g., vests, helmets, gloves) must be provided by the partner whenever necessary, according to the nature of the experience and legal requirements.

6.5.Exclusion of Liability and Compensation

  • Trueodysseys is not responsible for any damages, losses, or injuries resulting from participation in activities, except in cases of proven negligence directly attributable to Trueodysseys.
  • In situations of non-compliance in the execution of services (e.g., failure to deliver the purchased activity, discrepancies in advertised details), users should try to resolve the issue directly with the partner but may request Trueodysseys's intervention if needed.
  • If applicable, the user may seek compensation from Trueodysseys by submitting complaints, legal claims, or any applicable procedures (including through legal channels) if there is a violation of these Terms and Conditions or unauthorized use of their information.

7.Intellectual Property

7.1.Copyright and Trademark

  • All content present on the Trueodysseys platform (texts, images, logos, trademarks, graphic elements, website design) are protected by intellectual property laws and belong exclusively to Trueodysseys or its partners.
  • It is strictly prohibited to copy, reproduce, distribute, publish, modify or publicly display, in any form, any material made available, without prior written authorization.

7.2.Platform Usage

  • The user receives only a limited, non-exclusive and non-transferable license for personal use of the platform, in accordance with these terms and conditions.
  • It is not permitted to use, directly or indirectly, practice reverse engineering, decompile or create derivative works based on any platform software or application.

7.3.Third-Party Content

  • Partners may share content (e.g., text, images, videos) about their experiences. This content remains under the ownership and responsibility of their respective owners.
  • Any additional use (commercial or advertising) of this content requires express authorization from the rights holder.

7.4.Brands and Distinctive Signs

  • The brands, logos and designations displayed on the Trueodysseys platform, which do not belong to Trueodysseys, are property of their respective owners and are legally protected.
  • The user may not use, reproduce or publicly display these distinctive signs without proper authorization.

7.5.Violations and Restrictions

  • In case of suspected violation of intellectual property rights, Trueodysseys may restrict access to the platform and/or take other measures provided by law.
  • If any user or third party identifies content that may infringe intellectual property rights, they should contact Trueodysseys via email at support@Trueodysseys for proper analysis and removal of content, where applicable.

8.Refund Policy

8.1.Applicable Legislation and Specific Conditions

  • All refunds are processed in accordance with applicable legislation, particularly Portuguese consumer protection law.
  • The specific conditions of each experience (see also Section 5 and partner policies) may affect the right to refund.
  • Certain activities may have extra rules for cancellation or refund, due to the nature of the service or partner requirements (e.g., non-refundable tickets, fixed dates, etc.).

8.2.Right of Withdrawal (14 Days)

  • If the purchase was made exclusively online and the experience has not yet been used or scheduled, the user may exercise the right of withdrawal within 14 days from the purchase date.
  • This right does not apply if the experience has already been used, or if it's a service with a specific date/time that has already passed within these 14 days.
  • To exercise the right of withdrawal, the user must contact Trueodysseys through official channels, providing the order number and other requested information.

8.3.Instant Reservations

  • For experiences with 'instant booking' with date and time set at purchase, the user can cancel or modify free of charge up to 24 hours before the start of the experience.
  • Cancellations made within 24 hours before the experience may not be eligible for refund, unless the partner's policy states otherwise.

8.4.Already Scheduled or Used Experiences

  • As a rule, for experiences with a previously scheduled date, if the cancellation period has expired or the activity has already been used (fully or partially), there is no right to refund.
  • Failure to attend ('no-show'), without prior agreement for rescheduling, implies loss of the paid amount.

8.5.Vouchers

  • A voucher is a digital title that grants the bearer the right to enjoy a specific experience according to the established conditions.
  • If the voucher has not yet been used or scheduled, the user may invoke the right of withdrawal (14 days), provided that the experience has not been scheduled to the contrary.
  • Once used or reserved for a specific date, it will not be possible to refund the voucher value, unless there is cancellation within the terms provided (e.g., Section 8.3 or force majeure).
  • The validity of the voucher (deadline for scheduling or use) is defined in Section 5 and in the partner's policies. After the validity expires, there will be no refund or extension unless otherwise agreed with the partner.

8.6.Force Majeure and Special Cancellations

  • In cases of force majeure (e.g., severe weather conditions, government restrictions, unforeseen technical problems), the partner may cancel or postpone the experience for safety or impossibility reasons.
  • In these situations, Trueodysseys, together with the partner, will assess whether there is grounds for total or partial refund if the user cannot or does not accept rescheduling.

8.7.Refund Request Procedure

  • If the experience for instant reservation occurs more than 24 hours before the start, the user can cancel or modify directly on the website. For cancellations less than 24 hours, the user must contact Trueodysseys by email (support@Trueodysseys) or through official support channels, in accordance with the stipulation in previous sections.
  • If it is a voucher activity, not scheduled or only assigned the presentation of the voucher, the user still within the 14-day period (right of withdrawal) and without the experience having been used, can cancel directly on the website, using the voucher reference.
  • Once scheduled or if the experience has been marked/used, cancellations are not guaranteed, following the conditions of each partner as provided in previous sections.
  • Trueodysseys will facilitate the request and communicate the decision to the user within a period of five days. In case of deferral, the refund will be made, as a rule, by the same payment method used, within 14 days.

9.Force Majeure

9.1.Definition and Applicability

  • None of the parties (Trueodysseys, Partner, or User) will be held responsible for non-compliance or delay in fulfilling obligations resulting from these Terms and Conditions, if such non-compliance or delay is due to force majeure.
  • Force majeure cases include, among others, natural disasters, severe pandemics, war or armed conflicts, civil unrest, governmental acts or legal restrictions, power or energy interruptions, or any other events that are beyond the parties' will and control and that make it impractical to fulfill the established obligations.

9.2.Suspension of Obligations

  • In force majeure situations, the affected obligations will be suspended during the period in which the circumstances persist, without giving rise to compensation for non-compliance.
  • As soon as the effects of the force majeure event cease, the affected party must resume fulfilling its obligations in the shortest possible time.

9.3.Communication

  • The party invoking force majeure must notify the other parties, preferably in writing, as soon as possible, indicating the nature of the event and its expected impact on the fulfillment of obligations.

10.Safety and Risks

10.1.Partner Responsibility

  • Each partner is responsible for complying with legal health, safety, and licensing standards applicable to the activity they offer.
  • The partner must clearly and previously inform of any specific risks associated with the activity, including restrictions or cases where participants may be affected.
  • For activities requiring safety equipment (helmets, ropes, capacity limits, etc.), the partner must provide them and properly instruct the user on their use.

10.2.Participation Conditions

  • Certain activities may require physical preparation, prior experience, or medical examinations (e.g., diving, extreme sports). The user must verify if they meet the conditions to participate.
  • In some situations, the partner may require the signature of a liability waiver or statement of risk awareness, without which participation may not be permitted.

10.3.Safety-Related Rescheduling

  • If external factors (adverse weather conditions, technical failures, threats to public safety, etc.) compromise the safe execution of the activity, the partner has legitimacy to cancel or postpone the experience.
  • In these situations, the partner must inform the user as early as possible and, if applicable, provide rescheduling alternatives or refund according to the policies in force.

10.4.Exclusion of Trueodysseys's Responsibility

  • Trueodysseys acts solely as an intermediary, neither organizing nor executing activities directly.
  • Therefore, Trueodysseys is not responsible for damages or losses resulting from acts or omissions of the partner, nor for accidents occurring during experiences.
  • Any claims related to non-compliance with safety standards should be directed first to the partner. Trueodysseys may provide support in communication but assumes no direct liability for incidents.

10.5.Personal Property and Damage to Third Parties

  • The partner and/or user are responsible for safeguarding personal items, with no right to refund or compensation for loss, theft, or damage during the activity, except in cases of proven negligence.
  • If the user causes damage to third parties, facilities, or equipment used during the experience, they will be exclusively responsible for the costs and associated compensation.

10.6.Insurance and Additional Coverage

  • For high-risk activities, the partner must provide personal accident insurance or compatible coverage as required by law.
  • The user must confirm if the coverage offered by the partner is adequate for their needs, and may opt to contract additional insurance, which is entirely their responsibility.

11.Dispute Resolution

  • In case of dispute, users may resort to alternative dispute resolution entities (ADR), in accordance with Law No. 144/2015, of September 8, which transposes Directive 2013/11/EU on alternative consumer dispute resolution.

  • If it is not possible to resolve the dispute through extrajudicial means, the competent jurisdiction will be that of the consumer's domicile.

12.Changes to Terms and Conditions

Trueodysseys reserves the right to modify these Terms and Conditions at any time. Relevant changes will be communicated to users, with the most current version always prevailing on the platform.
